TUPE TRANSFER – GATWICK STATION OPERATIONS TO SOUTHERN RAILWAY

I write further to Circular IR/498/11 dated 10th November 2011. As previously stated, a consultation commenced regarding Network Rail’s proposal to transfer their Gatwick Station Operations to Southern Railways which would affect all station operations staff based at Gatwick station. This transfer is scheduled take place on or around 20th January 2012.We have received further correspondence regarding this matter which was placed before the General Grades Committee which made the following decision.

‘We note the latest correspondence on file and instruct the General Secretary to ensure that our members are not disadvantaged through the T.U.P.E. process, particular reference is to be made to item 14 of the proposed contract in relation to a probation period following a T.U.P.E. transfer, and also items 23 and 26 in relation to collective bargaining and changes to terms and conditions.

All terms and conditions are carried through at the point of transfer and there is no need for a probation period, and further any changes to T&Cs are made through collective bargaining.

All relevant branches and regional councils to be informed.’
