REORGANISATION OF NETWORK RAIL MAINTENANCE
Further to previous correspondence on the above matter, there are have been a number of matters outstanding following the reorganisation and which have been subject to an exchange of correspondence or discussion between the company and your union. These matters have been considered by the General Grades Committee, which has taken the following decision:
“That we note the correspondence from Network Rail covering Bank Holiday Arrangements applying to former Amey and Carillion (GTRM) staff, Productivity Incentive Scheme resulting from Phase 2 B/C. Additionally, the matter of PDTA – mileage allowance being taxable was raised with the company and in turn legal advice has been received on this matter.
Firstly, on the issue of PDTA – mileage allowance being taxable, we note from the legal advice and supporting material from HMRC that this allowance is indeed subject to tax.
Secondly, with regards to the Productivity Incentive Scheme we have now received a final draft of the proposals from Network Rail. Therefore, the General Secretary is instructed to facilitate an urgent meeting with our Network Rail Maintenance co-ordinators, Senior Assistant General Secretary and members of the General Grades Committee in attendance. The purpose of this meeting is to discuss/address the content of the Productivity Incentive Scheme before endorsement by the General Grades Committee.
Finally, with regards to the Network Rail Maintenance Phase 2 B/C arrangements and the Bank Holiday Arrangements for former Amey and Carillion staff (GTRM), having considered the legal advice, which can be found on file, which Network Rail differs from, we instruct our affected members to pursue an employment tribunal claim under section 11 of the Employment Rights Act 1996 for a declaration that the right to a day in lieu when you work a bank holiday is a contractual right.
